These Terms of Service ("Terms") govern your access to and use of the LATCH website, mobile applications, software, and related services operated by Mendoza Ventures LLC ("Mendoza Ventures," "LATCH," "we," "our," or "us").

By accessing or using LATCH, creating an account, or registering for launch communications, you agree to these Terms. If you do not agree, please do not use our services.

LATCH is a motion-aware driving safety platform designed to help reduce distracted driving by limiting access to selected mobile applications during detected vehicle movement.

The LATCH product family includes:

LATCH Individual: Designed for individual drivers, providing driving detection, application restrictions, secure trip completion, and driving activity summaries.

LATCH Family: Designed for families and parents seeking to encourage safer driving habits. Family administration, participating driver accounts, and reporting capabilities may vary based on availability and configuration.

LATCH Fleet: Designed for commercial organizations seeking driving safety controls and compliance-related reporting. Fleet capabilities may include driver identification, administrator access, NFC-based trip authentication, and PIN fallback procedures.

Certain features, including cross-device reporting and cloud synchronization, may be under development or unavailable in the current version.

We may modify, improve, suspend, or discontinue features as the platform evolves, subject to applicable law.

LATCH is intended to support safer driving habits. It is not a substitute for attentive driving, responsible judgment, or compliance with applicable traffic laws.

Drivers remain responsible for operating their vehicles safely.

Users must not interact with LATCH, change application settings, or attempt to override restrictions when doing so would create an unsafe driving condition.

LATCH does not guarantee the prevention of distracted driving, collisions, injuries, fatalities, or other unsafe behavior.

LATCH relies on device sensors, operating-system capabilities, permissions, and user-selected configurations.

Driving detection and application restrictions may be affected by:

• Device compatibility and sensor accuracy.
• Operating-system restrictions or software updates.
• Location and motion permissions.
• Application selection and shielding configuration.
• Device settings, battery conditions, or technical interruptions.
• User actions and circumstances outside LATCH's control.

LATCH does not guarantee that every driving event will be detected, every application will be restricted, or protection will operate without interruption.

Trip summaries, compliance scores, and related measurements are informational indicators. They do not establish that a driver was attentive, distraction-free, or operating a vehicle safely.

Certain LATCH features require an account.

Users agree to provide accurate account information and maintain the security of their credentials.

Users are responsible for activities conducted through their accounts, except where applicable law provides otherwise.

LATCH may support email authentication, Sign in with Apple, and other authentication methods depending on the application version.

Authentication features may depend on third-party identity providers.

Users should promptly notify LATCH if they suspect unauthorized account access.

We may restrict or suspend access when reasonably necessary to address security threats, misuse, unlawful activity, or material violations of these Terms.

LATCH Family is intended to support responsible family driving practices.

Parents, guardians, and family administrators must have appropriate legal authority to enroll or administer participating users.

Any monitoring, reporting, or sharing of driving-related information must comply with applicable privacy laws and other legal requirements.

Family reporting and cross-device synchronization may not be available in all versions of LATCH.

When these capabilities become available, access to family information will depend on applicable account relationships, permissions, and product configuration.

Family administrators must not use LATCH to unlawfully monitor, harass, or control another person.

LATCH Fleet is intended for authorized commercial and organizational use.

Fleet administrators are responsible for obtaining required permissions, providing legally required notices, and complying with applicable employment, privacy, and transportation laws.

Organizations are responsible for determining how they use driving activity and compliance information.

LATCH does not independently determine whether an organization's monitoring practices or employment decisions comply with applicable law.

Fleet-specific features, commercial agreements, pricing, and service conditions may be governed by additional terms.

LATCH may use PIN authentication, device-supported biometric authentication, NFC credentials, or other methods to support trip completion and access restoration.

These mechanisms support application workflows and do not guarantee protection against unauthorized access or misuse.

Users are responsible for protecting PINs and other authentication credentials.

Emergency access and fallback procedures may vary by product and configuration.

LATCH may provide driving summaries, weekly recaps, milestones, achievements, and other informational statistics.

Certain summaries may be shared voluntarily through device-supported sharing features.

Users are responsible for deciding whether and where to publish shared content.

Once information is shared with a third-party application or service, that third party's policies and practices may apply.

Driving achievements and compliance statistics should not be interpreted as certifications of driving safety.

Users agree not to:

• Use LATCH for unlawful purposes.
• Intentionally interfere with platform operations or security.
• Attempt unauthorized access to another user's information.
• Misrepresent their identity or authorization.
• Use Family or Fleet features for unlawful surveillance.
• Reverse engineer or misuse protected software except where permitted by applicable law.

Users must comply with all applicable laws when using LATCH.

Some LATCH services may be offered free of charge, while optional features or commercial services may require payment.

Any applicable prices, purchase terms, and subscription conditions will be disclosed before purchase.

Purchases processed through Apple's App Store are subject to applicable Apple payment and refund procedures.

Availability and pricing may change, subject to applicable law and existing purchase commitments.

The Privacy Policy explains how personal information is collected, processed, stored, and shared.

LATCH software, branding, hardware designs, documentation, and related intellectual property are owned by Mendoza Ventures LLC or its licensors.

Users receive a limited, nonexclusive, nontransferable right to use the services in accordance with these Terms.

No ownership rights are transferred to users.

We aim to provide reliable services but do not guarantee uninterrupted availability.

Maintenance, technical issues, operating-system changes, and third-party service disruptions may affect functionality.

Users should not rely on LATCH as their sole means of ensuring safe driving behavior.

To the extent permitted by applicable law, LATCH is provided on an "as available" and "as is" basis.

We disclaim warranties not expressly provided in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement, to the extent such disclaimers are legally permitted.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

To the fullest extent permitted by applicable law, Mendoza Ventures LLC and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use LATCH.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

Users may discontinue using LATCH at any time.

Account deletion may require identity verification and may be subject to applicable legal requirements.

Deleting an account does not necessarily remove information previously shared with third parties or locally stored information on devices that are no longer accessible to the user.

Certain information may be retained when required or permitted by applicable law.

We may update these Terms as our services evolve.

The current version will be published on our website with an updated effective date.

Where required by law, we will provide additional notice or obtain consent before material changes take effect.
